Please read these Terms of Service ("Terms") carefully before using iBench Player Pro ("the Application", "the Software", "we", "us", or "our"). By creating an account, downloading, installing, or using our Application or website, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Description of Service

iBench Player Pro is a digital media player application ("Application") for Android-based devices including smart TV boxes, smartphones, and tablets. The Application provides the following software features:

• A media player interface for playing digital media files and playlists
• Playlist management tools supporting the M3U file format
• Device registration and authentication via unique hardware identifiers
• A web-based account portal for managing devices and playlist configurations

iBench Player Pro does not provide, host, broadcast, transmit, sell, or distribute any media content, channels, programmes, or recordings of any kind. We are solely a software provider. The user is entirely responsible for the content they choose to access, load, and play through the Application.

2. Eligibility

You must be at least 18 years of age to use this service. By using iBench Player Pro, you represent that you meet this requirement and have the full legal capacity to enter into and be bound by these Terms.

3. User Accounts

To access paid features, you must register an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your login credentials
• Promptly notify us of any unauthorised access to or use of your account
• Accept full responsibility for all activity that occurs under your account

We reserve the right to refuse registration or cancel accounts at our discretion.

4. Free Trial

New accounts are entitled to a 7-day free trial period. During the trial:

• No payment information is required to activate a device
• Full Application features are available
• The trial is available once per user/email address

After the 7-day trial expires, a paid licence plan is required to continue using the Application. You will not be charged automatically at the end of the trial.

5. Subscription Plans and Payments

We offer the following software licence plans, all priced in US Dollars (USD):

• Annual Plan ($9.99/year): A 12-month licence for one (1) device.
• Lifetime Plan ($29.99, one-time): A permanent, perpetual licence for one (1) device.
• Lifetime 3-Device Plan ($89.99, one-time): A permanent, perpetual licence for up to three (3) devices.

All payments are processed securely through our third-party payment processor. By completing a purchase, you authorise us to charge your chosen payment method for the applicable amount. Prices are subject to change; existing paid subscriptions will not be retroactively affected.

6. Acceptable Use

You agree to use iBench Player Pro only for lawful purposes and in compliance with all applicable local, national, and international laws. You must not:

• Use the Application to access, play, or distribute any content you do not have the legal right to access
• Attempt to reverse-engineer, decompile, modify, or create derivative works from the Application
• Circumvent, disable, or interfere with any security or authentication mechanism
• Share your account credentials or device licences with unauthorised third parties
• Use the Application for any commercial redistribution purpose without our express written consent
• Use automated tools, bots, or scripts to interact with our services
• Use the Application in any manner that violates our Acceptable Use Policy or applicable law

7. User Content Responsibility

You are solely and exclusively responsible for any content you load, access, or play through the Application, including any third-party playlist URLs or media files. You represent and warrant that:

• You have the legal right to access and use any content you load into the Application
• Your use of such content does not infringe any intellectual property rights, privacy rights, or other legal rights of any party
• You will comply with all applicable copyright laws and licensing terms

We expressly disclaim all responsibility and liability for any third-party content accessed through the Application.

8. Intellectual Property

The iBench Player Pro Application, website, branding, interface design, and all associated software are our exclusive intellectual property, protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Application for personal, non-commercial purposes, subject to full compliance with these Terms. No rights, titles, or interests are transferred to you beyond this limited licence.

9. Disclaimer of Warranties

The Application and all related services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Application will be error-free, uninterrupted, or free of harmful components. We make no representation regarding the legality, quality, accuracy, or reliability of any third-party content accessed through the Application.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of data, loss of revenue or profits, loss of goodwill, or any damages resulting from: (a) your use or inability to use the Application; (b) any third-party content accessed through the Application; (c) unauthorised access to your account; or (d) any other matter relating to the Application. Our total aggregate liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Termination

We reserve the right to suspend or permanently terminate your account and access to the Application at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law. Upon termination, your licence to use the Application ceases immediately. Termination due to a Terms violation does not entitle you to any refund.

12. Changes to These Terms

We may revise these Terms at any time. We will notify registered users of material changes by email or by prominent notice on our website. Your continued use of the Application after the effective date of any change constitutes your acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and interpreted in accordance with applicable laws. Any disputes arising out of or in connection with these Terms that cannot be resolved informally shall be subject to binding arbitration or the exclusive jurisdiction of competent courts, as applicable under local law.
